An LPA is a legal document that enables you to choose someone (or more than one person)
that you trust to make decisions on your behalf about things such as your property and
financial affairs or health welfare, at a time when you no longer are able to make those
decisions. This can save a great deal of money and distress, and will ensure that your
affairs will be handled correctly and speedily.
If you lose mental capacity without an LPA in place, it will be necessary for your family
to apply to the Court of Protection to have a deputy appointed to deal with everyday
financial matters. This is a slow and very expensive process, costing thousands of pounds.
If you have to use a lawyer, it could cost a lot more. If you already have an LPA arranged,
this will not be necessary.
A Property and Financial affairs LPA is for decisions about finances, such as
selling a property, managing a bank account or dealing with other institutions.
A Health and Welfare LPA is for decisions about health and personal welfare,
such as where to live, day-to-day care or having medical treatment. This is most
pertinent in cases of mental incapacity.
